My question involves a traffic ticket from the state of: California
I'll try to make this as short and sweet as possible. driving along 280 (55mph) in San francisco, take an exit for San jose avenue, where a black and yellow "35mph exit" sign is displayed. The ramp makes slight turn into a tunnel going under the freeway. At the exit of the tunnel a sign with flashing words that says "your speed: slow down." another 40-50 yards down the road is another sign that reads "speed limit 35". shortly after this I see I few cop cars with people pulled over and one of the cops on a motorcycle pulled up behind me and turned his lights on. There was not a safe spot to pull over because of a coned off bike lane so I continued for a few blocks until I could pull to the side. The ticket is for basic speed law, with a speed apx of 55mph, pf/max is 35mph, and it says laser: 58.
I want to fight using trial by written declaration, I know the basics of what I need to do with the court and all that. my areas of concern are as follows, but I am curious as to what you all think is my best arguement and what will help me win.
1. I have a radar detector, it did not detect laser, but it did detect k band radar as I exited the tunnel. (Often this is caused by the speed detecting signs) I'm not sure if this is something that would help me at all
2. The location of the violation according to the ticket is "nb San jose avenue at st Mary's". This location is 3-4 blocks AFTER he pulled behind me. At this point I was very aware he was behind me and therefore was extremely cautious of my speed.
3. I did not feel as if I was causing danger at all, and cv 22350 does not refer at all to the posted speed limit, just the safety regarding weather and traffic
4. Can I use a speed trap defense? I plan on getting the engineering survey but I'm not sure if this would be a valid speed trap location.
