My question involves labor and employment law for the state of: Nevada
Hello!
The girlfriend was let go of yesterday here in Las Vegas - the only reason given was that her boss did not have time to train her and that she felt she would do better in a larger complex. She was asked to stay this weekend while her boss interviews other clients (in front of her) to fill her position.
My girlfriend is a Leasing Consultant/Agent or shows prospective clients apartments and helps in renting them. The complex is owned by a larger company which owns quite a bit of property.
In full knowledge that my girlfriend had not previously worked as a Leasing Agent aside from helping her parents out (property managers a number of years back) while she was a child.
Her first day of employment the manager left her to learn everything herself. If she'd ask any question even the first day the manager would say things like "I don't have time for this." or "I don't have time to train you."
The second day of employment she was left completely alone to run the complex herself with maintenance. She rented two apartments which her manager then told her she was very experienced and the last leasing agent had only rented one in months.
She continued to work there for about 5 weeks and took the apartment complex from 69% occupancy to 100% while getting gifts (christmas time) and a lot of positive feedback from tenants.
The whole time her manager would constantly complain about having to work and about how she did not want to be there. She would take cigarette or bathroom breaks every ten minutes, take naps, or in general would take the entire weekend off (my girlfriend worked weekends and mondays.) My girlfriend mentioned several times that she had asthma and hadent had instances of it acting up until she was working here.. Then after she'd be walking with the manager during the day she would come home unable to breathe and up all night, but her manager continued to smoke around her often. If she would go to show an apartment with her manager her manager would emphasize the potential clients complaints about how bad the apartment was while the girlfriend would try to change them into positives and did well at it obviously taking them to 100% occupancy just before being let go...
The manager would have unrealistic expectations of her and continuously blame her for things that were actually the managers fault. The other day for example. Her manager asked her where her backup drive (computer drive) was and my girlfriend responded that she had last seen it on her managers desk but had not touched it. Her manager then got right up in her face and said "I didn't ask you if you touched it, I asked you Where IT IS" in a very harsh/threatening tone. A few minutes later her manager found it in her own desk drawer and apologized to my gf but had done things like this a number of times.
Another example I believe last weekend she was filling out a 6-month lease for a tenant in the office. There was an obvious error on the lease form that her manager gave her so she told the tenant she would have to point the error out to her boss before proceeding. She pointed out the specific error and her boss said go ahead and process it, not to bother her as she's busy. Afterword her boss got furious and began yelling at her for processing it with the error. The tenant still in the office became upset with the manager and said "Are you really going to blame her for your error?"
There's plenty of other instances and I can have her retrieve tenant contact information if needed, and the maintenance man who was often with both of them. She also felt a bit uncomfortable around her as she'd turn around and catch her boss staring at her butt on several occasions and early on did mention something to her about she bet she liked coming home to me at night in a sexual suggestive way...
What potential claims or what would be the best way to pursue this?
Also. I suggested contacting her bosses employer earlier on in her employment after her boss refused to help train her and would constantly take off work or take naps at work while blaming the girlfriend for problems, but she was a bit afraid to do this as she went to a Christmas party and everyone seemed to know and like her boss and she found out her boss has been with the company for over 20 years.
