My question involves a tow taking place in the state of: California
At 3:30 in the morning on Monday, 1/12 my car was towed from my apartment complex of residence. Upon my discoverance of the car being missing (1/12, 9:30 am) I called the police who reported it was taken to a tow yard in Garden Grove. The tow yard stated that the vehicle was towed for "missing permit". Upon my arrival and inspection of the vehicle, the placard was /voila/, right on the dashboard. After apologizing profusely and saying they were merely following the orders of the landlord, they let me take the vehicle off the lot for no charge. Upon arrival back at my apartment complex I confronted management who gave me a letter for my employer explaining my absence (it's now 3PM) wherein they ADMIT that the car was WRONGFULLY TOWED. Do I have recourse against the management company and/or the tow yard for the hassle and lost wages? I fail to see how this practice doesn't amount to grand theft auto, especially if they're using it to extort money from tenants.
