Traffic Accidents: Who is Responsible for the Storage of a Vehicle Insurance or Claimant

My question involves an injury that occurred in the state of: California



I was hit by an uninsured drunk driver on October 15 2014, The car was towed out of the scene of the accident because it was completely damaged. I was taken to the hospital by ambulance.

I made a claim with my insurance the same day of the accident, I had full coverage.

8 days after the claim (October 23rd) they send me a letter saying that they are opening an investigation on the coverage (to determine wether they will cover the me or not) and that I am responsible for the storage of the vehicle while they are doing so.

at that time the storage fees were already about 1500$



it is now the end of January 2015, they just decided that they will be covering the car. but they are deducting the salvage value of the vehicle as if I was buying the car back because they don't want to pay the now $7000 storage fees. so I would still have to pay about $6000 to the bank



1st question : before they decided to open an investigation between October 15 to 23rd, who was responsible for the storage ? should they have taken the car out of storage as soon as they found out about the accident. ?



2nd question : since they are the ones investigating the coverage, and they actually agreed that they are liable for the car, shouldn't they be the ones paying for the fees that incurred while they were investigating ?
