Traffic Lights, Signs and Controls: Ticket for Turning Left on a Yellow Light

jeudi 8 janvier 2015

My question involves a traffic ticket from the state of: Iowa

Hello, I am new to this forum and not too familiar with law so I would like to know if I could make a certain defense if I decide to fight this ticket.

The situation:

It was night, I was making a left turn at a fairly large intersection. There were were two cars in front of me that were going rather slow making the same turn. The light turns yellow as the car I'm behind goes through. I follow the car and make it into the intersection before the light turns red, but we continue to go slow so I am in the intersection longer than I expected to be. On the other side of the intersection a cop cars pulls up to make a right turn into the lane I'm in. I pass the cop car then they pull me over on the claim that I ran a red light because she had a green arrow to turn left as I was going through the intersection. The official violation on my ticket reads "Fail to obey traffic signal."

I don't think I can make the claim that I couldn't stop safely at the yellow light, so technically I failed to obey the yellow light. However, I was wondering if I could make a defense claim that since the officer was on the opposite side of the intersection facing the back of my traffic light, they could not clearly see the light and make the judgment that I failed to obey the traffic signal.

I would also appreciate any other advice for this situation. This is my first ticket and I have a clean record. I'm a bit upset for getting a $200 fine for turning left on a yellow light.
