Compensation and Overtime: Employer Scamming Drivers for Deserved Commission

My question involves employment and labor law for the state of: New York



Myself and dozens of other drivers feel we are being scammed out of "commissioned" pay due the following facts;



The car service in question has a contract, with the local County Governent, at a local medium sized airport to provide ground transportation for persons exiting the aircraft.



The company skims the fares thereby reducing the drivers wages. Here is an example.



Drivers are supposed to earn 20% commission, on the FARE obviously.

The County (Found in the 5 yr. contract) approves the rates. They are to include "the fare and any tolls involved". One fare for instance is $50. Now, to reduce the driver's pay and take away from the driver "due compensation" (commission), the breakdown on the receipt is this; $40 + $10 STC fee.



So now the scam is that the driver gets paid on the $40, not the $50 as they should.



STC "surface transportation charge" is a made up term limo services have adopted claiming it as a way to cover "overhead" or airport fees, basically, the cost of doing business, which traditionally, as we all know, is in the "fare" or amount being charged for the services provided... It's a bogus fee, which in this case has not been approved by the County (which holds the contract) and is not stated to be in the "fares" as the county has approved.

This started about 3 years ago when the daughter of the owner took over as CEO and changed the rate of pay from hourly to commission. This is allowing the company to earn more money by basically paying the drivers less.



I would like a class action suit to force the company to pay all the drivers effected by this disgusting stealing of persons true earnings....
