Estate Assets and Debts: Should We Give It Up

My question involves estate proceedings in the state of: California



Mother died several years ago. Father sold the house $1.2 million. Got himself an immigration wife. Father told the kids that she (new wife) is going to get everything and they (the kids) will get nothing. No will or prenup to say otherwise. A few years pass. They (father and new wife) buy a new house together joint ownership. He (father) died a few days ago.



My brothers and I are assuming that in California if a man dies the wife automatically gets 100% ownership of the house and all the money they had together. One of the brothers said to just give it up. I am pretty sure that in California the wife card trumps children. Just wanted to check here to confirm that this is the case.
