Estate Assets and Debts: What Happens If Heirs Can't Agree on How to Divide a House

vendredi 10 octobre 2014

My question involves estate proceedings in the state of: South Carolina

What happens if the personal representative wants me to move out of the family home and into an illegal garage apartment so she can move into the home where I currently stay during probate (and I don't want this to happen)?

What happens if she wants to co-own the property and I want to sell? Can she basically force me to sign a TIC type agreement?

What happens if we do not agree on how to divide a house by the deadline to close an estate in South Carolina? Can we just sit on it forever without distributing or selling it?

Does a petition to the court to sell usually end in an auction (or other sale below FMV) in South Carolina?
