My question involves an easement in the state of:Maryland
We are looking at purchasing a piece of property that has a long winding driveway. The neighbor uses this same driveway, but it is on the land we plan to purchase. I was told their was no maintenance agreement, or right-of-way.
I got a copy of the deed for both properties and there is nothing stated in there about easements or driveway maintenance. The driveway is paved, but in serious need of repaving. It would cost, easily $10,000+ to repave.
I'm told by the real estate agent that the "other" property owner had declined entering into any agreement regarding the driveway and said they will not pay for any maintenance.
What are my legal rights if I purchase this property? I doubt I can block access to their home, but they currently do not have any written legal right to use the driveway. Can I force them to either enter into an agreement?
