My question involves medical malpractice in the state of: PA

Can a psychiatrist be held responsible (medically or financially) for continuing to prescribe a drug addict medication that he or she is using to get high off of? Ambien specifically. Said addict has over-dosed on Ambien multiple times and was arrested for DUI (later dropped) for driving while intoxicated on Ambien. Addict has been in to the County's behavioral health unit at least 4 times, each time same psychiatrist keeps writing prescriptions for Ambien, knowing that this individual has over-dosed and crashed while abusing this medication. Can the family hold the psychiatrist responsible? Damages would be all the money addict's family has spent for treatment, medical care bills, pain & suffering.
