Payoff: No Contact Made by Bank and Now in Repo

mardi 14 octobre 2014

My question involves an auto loan or repossession in the State of: Connecticut / Massachusetts

History:

I took this Auto loan in Nov 2009 in CT and have since paid on time. I had bill pay set up through my bank account and that was working perfectly so I didn't monitor it regularly. My loan was due to complete in Oct2014 and so when I looked at my Bill Pay - there had not been any payment made since March 2014. (I'll deal with my bank separately for this screw up).

(Moved to MA in 2010)

But my auto loan company - in the mean while had moved my loan to collection and now to repo. I called them the day I found this issue and paid in full.

My questions:

1) They had my CT address on records and my current phone number. So I understand not receiving any mails from them but I did not receive even a single voice mail or call from their collection team in all these months? One alert from them and I could have fixed the issue. Is this a fair practice? Do I have any legal standing on this? My concern is only with respect to this impacting my credit score and rating. I have been blindsided. Yes, I am at fault as well for not checking my Bill Pay status but does the bank have no responsibility at all?

a) All I want them to do is to fix my credit report? Do I stand a chance or legally is it just me that is at fault?

Thanks

Vikash
