Service Providers: Moving Company Avoiding Paying for Damage

My question involves a consumer law issue in the State of: New Mexico



My husband and I recently moved to New Mexico for my job, and hired a moving company to deal with the bulk of our belongings. From start to finish the moving company has been a complete nightmare: promising delivery dates and not following through, ignoring all our phone calls and e-mails and then damaging a large portion of our belongings. After we finally received our belongings (two weeks late), I went through and took pictures of everything that was damaged. With those pictures I made a spreadsheet with descriptions of the damage and the actual cost of replacement (with proof). I was told by a sales rep to send the spreadsheet with pictures to him and he'd forward it on to their claims department.



Here's one tidbit of information: the company will only offer recuperation for damage claims for $0.60/lb. However, they don't price per pound when they estimate the cost of their service (they charge per cubic foot) and at no time did they weigh the truck with my belongings in it. Kind of hard to prove weight when they didn't get that information in the first place.



Well, it's been over two weeks and the company is again ignoring me. I realize that is very little time to get a claim settlement, I'm just thinking for the future if they continue to ignore me and my damage claims. My question is two fold. Can the moving company still require reimbursement in the form of per pound, if they failed to weigh my belongings in the first place? Though I did agree to this in the contract, neither myself nor the company has weighed any of the items. Also, if the company fails to reimburse at all for my claim, what would be viable options to compel them to take me serious, besides outright suing?
