Trade-Ins: Advertised Trade-in "Program" (Even with Fine Print, Would Not Honor)

mercredi 22 octobre 2014

My question involves a consumer law issue in the State of: INDIANA

Related to a vehicle (dealership) advertisement bait and switch or false advertisement (?).

Since they wouldn't honor their advertisement (I met the fine print), can I sue the dealership(s) for time wasted or force them to honor it (preferred)?

The reason they balked: My vehicle is a 2014 (current year) and has less than 10k miles on it and there is absolutely nothing wrong with it. They were expecting a much older vehicle to come in so they could deduct for repairs, mileage, reconditioning, etc.

The first dealership, I emailed first (20 miles away) asking for the "fine print, restrictions and limitations of their trade-in deal". Their reply was that the only restriction was that they have to see vehicle.

The second dealership (close to home) wouldn't even come close to their ad. I spoke with a manager who went and spoke with the "appraiser" for about 40 minutes and came back and apologized, agreed with me but said they can't give me the "special".

After their offers, despite the ad, I did not make the purchase and I only wanted them to honor their advertisement.

The research I've done is usually for "after the fact" and the consumer had already made the purchase.

Thanks in advance...
