Chapter 13: Chapter 13 Was Upheld Due to Home Foreclosure 17 Months Before Chapter 13 Complete

samedi 15 novembre 2014

My question involves bankruptcy in the state of: Florida. First off, thank you to anyone that tries helping with my situation.

My wife and I have been paying our Chapter 13 for the previous 3 years and 7 months. We were asked if we wished to keep our home, which we did not, so we declined. Everything was going fine until last month, at which time our home was foreclosed on and halted our Chapter 13. The creditors were no longer being paid by our trustee, but we still mailed off the payment to the trustee.

The law firm that we originally selected assigned an attorney to us. She took a maternity leave of absence 2 months after filing our Chapter 13 paperwork. Another attorney in the same firm took us on as his clients and accompanied us to our hearing. We were told what our monthly payments would be, we accepted, and started paying the amount specified in the hearing.

About 2 years into the installments, another attorney called us to notify us that our previous law firm merged with her firm. We thanked her for telling us of the merger.

Last month, the last attorney told us that she left that firm after the merger and went to another law firm. She did ask, though, if anyone from her previous firm had contacted us to inform us that our Chapter 13 judgment had been stopped. We had not, as I told her.

Now, we have our creditors contacting us asking if we will re-file our Chapter 13. At this point, I don't even know who to contact, so I am asking for any assistance.

Thank you.
