Defamation: Remedy for a False Accusation of Making Threats

vendredi 16 janvier 2015

My question involves defamation in the state of:Arkansas

My mother was part of theft ring going on at a walmart project store. She was arrested for 30k in theft (the ring of people took 30k total and it is all being put on my mother). I had no knowledge of any of until way after she was accused of the crime. My fiance' works in the same building but not for walmart. He runs a 5 star food establishment inside the project store. The actual building however is owned by Walmart. The police are still investigating other employees of the store that were involved but that does not include my Fiance as he has been fully cleared of having anything to do with it. My mother told and helped the police 100% and is taking responsibility for her actions and is facing the music for the theft she did and is not in any way even trying to say she did nothing.

However today at work my fiance' was approached by the police because the three others involved in the theft ring accused him of saying that he would do bodily harm to them for turning in his mother-in-law to be. It was quickly dismissed by the police because for one it was here say, and he is not the one to do any sort of thing. The only thing every overheard is that he would make sure that the upper management knew that they were involved as well. The police left and one of the parties involved let everyone in the store know what was going on and called the loss prevention over from another store and he stayed my fiance's entire shift. At the end of his shift the owner of the company he works for came over and told him she had to fire him due to walmart banning him from the store because "he is a danger to others". Mind you he has no priors, has never had as much as a speeding ticket and has no history of violence or angry outbursts. Not once in the 8 years we have been together have I ever even seen him as much as threaten our dogs... I had him call the officer who questioned him and explain what happened and he was very nice and insisted no charges were being filed and the lady who says she was told he made the threats declined to press any charges. He also advised we seek a lawyer and sue walmart. I wanted any insight or advice on what we should do or how we should go from here. He has worked for his employer for well over a year and has been quickly promoted and has awards showing he is their best employee. The owner cried as she fired him and assured him she would give him unemployment without a fight and a 5 star referral for any future employment and also stated as soon as a position was open in their other stores she would re hire him as only one of their stores is in a walmart facility.

I'm sorry this was long winded but details of course matter in things such as this. Of course my opinion does not matter legally but I am assuming they wanted him gone in order not to get caught. Thank you in advance for any input as we just had a new baby and now have no income.
