My question involves landlord-tenant law in the State of: Tennessee
In January 2015 my Wife put a deposit down on an office space when she believed her current landlord was going to sell the building she is in currently. My wife and the landlord of the office space she was putting the deposit on had a verbal agreement that my wife would take possession on the new office space in April 2015 when her current lease was up. The verbal agreement stated that the new landlord would call my wife should someone else want to lease the space prior to April and my wife would have to either take the space or let it go at that time. The landlord was allowed to continue to advertise the space and the deposit was only to guarantee my wife had first pick if another party wanted to lease the space.
In early February, my wife found out that her current lease space was going to be available for two more years so she contacted the landlord from the new lease space and requested her deposit back. The landlord told her she would put a check in the mail that week. Two weeks went by and my wife did not receive a check so she tried to call the landlord again but could only leave a voice mail. My wife has called several more times only to be forwarded to voice mail and has not received a call back.
On 3/30/2015, I called the landlord from my phone and the call was answered. The landlord stated she was out of town and would cut a check the following Monday and put it in the mail. She gave all sorts of excuses why she had not sent a check prior to this. I sent a text to the landlord confirming our conversation and she replied that she would cut a check as soon as she got back in town. I received another text from her the Monday she was supposed to sent the check asking what address to send the check to. I sent her the address and asked if she was putting in the mail that day and she replied that she was. The landlord lives in the next town over from us so mail usually will arrive within a day or two. It has been a week and we have not received anything from the landlord. I have tried to call and send texts but get no response.
I would like to know what my options are? I would prefer to not have to take her to court. Are there any tips on how to get her to give the deposit back without going to court? I've tried to look up several options but could not find much detail on this particular situation. The Amount of the deposoit was $1,277.00. Thank you.
