Establishing an Order: Seeking Sole Custody Based on Domestic Violence

My question involves a child custody case from the State of: Michigan.



My daughters father had no involvement in my pregnancy. In the beginning he tripped me down the stairs while being pregnant so I left him. Right before she was born he promised he changed, got on medicine, and got help. I believed him but none of it was true. I allowed him to be at the birth and sign the birth certificate. In the hospital he was asked to leave due to him fighting with me. After I had her I continued to let him be in her life. In August of 2014 he punched me in my head while I was up north with his family. His family made me and my daughter leave and drive home on my own with no phone because he smashed it. We had no contact for 3 weeks. He then began seeing her here and there every few weeks. In July when she was 2 months old he kicked in my car door and broke my parents front door all in front of my daughter. Then a month or so went by and he would should up at my home pounding on my doors threatening me, calling me names while being drunk and high. I have called the police on him several times and he leaves prior to them getting here. On Christmas he physically attacked me while holding our daughter. That is the last time I let him see her. I filed 2 police reports. The damages to my car and a harassment report. I also tried getting a restraining order and was denied. I had no choice but to take him to take him to court over child support because she is on state insurance. He is now fighting me for visitation. I'm requesting no visitation and I want sole custody. He has also threatened me saying he was going to kidnap her, make sure her windows are locked, and that he was going to kill himself and that me and her aren't welcomed at his funeral. He has shown violence towards her by snatching her from my arms with force and has threw her to me. I had to put a stop to him seeing her for the safety of my daughter. He has a DUI on his record and possession charges. He has his medical marijuana card and gets high repeatedly. He even goes to his car to smoke while he has visited with my daughter. It is now going on 4 months since he has seen her. He never once petitioned the courts to see her. If it wasn't for child support I wouldn't be going through this. What are my chances?
