Medical Issues: How is FMLA Leave Calculated After Return to Work on Limited Hours

My question involves workers compensation law for the state of: NE



I am back to work approximately 9 hrs a week after being off for 7 weeks for a WC injury. If I am not back to full hours (40) a week am I still considered on FMLA?



I also am on WC for tendoniitis in both elbows at the same time as my broken foot. So my foot has put me on FMLA but my elbows may need surgery. I know you are only allowed 12 weeks a year so I am concerned.



Any help would be appreciated
