My question involves a traffic ticket from the state of: California.
I just recently got a speeding ticket on the 60 West freeway. The officer said I was going 83 mph according to his Radar, then charged me with violation of 22349 VC (a) which says " no person may drive a vehicle upon a highway at a speed greater than 65 miles per hour." There was absolutely no traffic, weather was clear but it was later in the night, affecting the visibility somewhat.
Unfortunate for me, I was suffering from really bad cold with constant cough and high fever, thus was not able to talk well as my voice was gone. My throat was so swollen that it was hurting even from swallowing saliva. I wish I was my normal self so that I could've talked it out in person. Anyways, my point is I'm certain I was not going over 80. I admit that I drive on average 70 mph or rarely 75 mph but always under 80 mph.
From what I've heard, there's about 100 dollar difference in fines for speeding 1-15 over and 16-25 over. I've also heard that if you go into court, the judge can easily lower your fine. Is my case still worth the shot - 18 mph over with radar - to appear before the judge just for the fine deduction? I was just going to appeal that I haven't had a traffic ticket within the past two years and that I could swear that I never go over 80 mph which is true.
Also just as a side note, I did receive a speeding ticket for going 75 mph on 65mph highway little over 2 years ago. I want to believe there isn't any record of this because I took the traffic school and payed the fine.
