Unlawful Eviction: Never Was Notified of My Court Date.default Judgement

vendredi 10 avril 2015

My question involves an eviction in the state of: California

I was served with a unlawful detainer . I filed my response and waited to be notified of the court date for trial. I then received a default judgement. and recieved a 5 day notice posted by the sheriff.I kept telling the manager I never received it. I went to the court house a day before I had to leave and found the document that was sent to me. The court clerk made a mistake and sent it to another city , had my name, had my address but somehow put in a different city. I went to the clerk and was able to request a stay based on the new information and the judge gave it to me and then schedule a new court date in 5 days. I want to request to set aside the judgement based on that so that I am able to have my day in court. The judge wanted me to pay over 1300.00 for rent that would be due based on the 40 day stay. I said i don't have it He granted the stay for 5 days until court. with out me paying per day.

. Because the court made this mistake does that give me automatic set aside as well? What happens next?

If myself or the plaintiff made a mistake we would be in troubled fined ect. What about the court ?
