Adoption of Children: Terminating Parental Right After Two Years Without Contact

mercredi 5 novembre 2014

My question involves adoption law for the State of: Pa

Ok I have a child with a man who thinks he can come in and out of her life when it is convenient for him. When she was born we were not married not together and when she was 11 months old my husband started being there for her. Her biological father visited about 7 times from birth until she was about 18mons old. Once we were married he did not have any contact with her for 2yrs. He then demanded to see her we discussed it and allowed him to come and visit her on Sundays until he established a relationship with her. So the plan was to ease her into it so she would not have a heavy emotional burden. He showed up the first time we stayed in case she had questions. The second time he came with 3 of this other children we left my mother stayed. He did not ask to see her again for two yrs and once again we made arrangements for him to see her he never showed up or called. Now he is demanding to see her. My husband wants to adopt her I understand the process but what I really what to know is can we use the child abandonment law to terminate his rights? Will the court grant him visitation if he files now even if we have tried it in that past various times? and if they do grant visitation and he does not show can I then file the abandonment? I do not want my child to have the same problems I had as a child where I was waiting for my father and he never showed my father broke my heart over and over again long before any other man had the chance and I don't want this for my child. Help please!!! (She does not know that my husband is not her biological dad. She does not know anything about her biological dad because he left the spot open for someone else to fill. She is 6)
