My question involves bankruptcy in the state of: PA
Hello, My husband and I had a Chapter13 with the IRS along with credit card debt. I lost my job 7 months ago, we converted the cc debt to chapter 7 and it was granted at the meeting of creditors today. Our lawyer has kept the IRS debt separate as he thinks our debt Approx 14,000 may not get us a chapter 7 with the IRS. I do not know what his plan is at this time, but we will meet with him on Friday.
I have filed form SS-8 in August with a load of proof which clearly shows I was missclassified as a sub contractor.. I mentioned this to my lawyer once and he had never heard of it..I explained it to him..but he brushed it off..I told him it will take some time for a decision.
I brought it up a second time and once again he brushed it off. In my opinion, I think it is very important for the court or trustee to know this information being that the decision will most likely be in my favor which would cut my debt in half.
Can I please have your thoughts on this as to how I can get my lawyer to listen to me or perhaps get him to find out the status of my SS-8 case with the IRS, even to possibly speed up the process?
Otherwise If we go forward to settle the IRS situation "as is" it will only have to be amended after their decision on my workers status has been made.
