Application: Resume or Job Application Falsification. with a Twist Out of the Ordinary

My question involves labor and employment law for the state of: North Dakota.



Hi, I was hoping someone here might be able to help provide me information to persuade my son from not doing this. Basically what is happening is that he wants to get into a management position, he does not have management experience so he is considering lying on his resume or job application stating he has done managerial work before. He is aware and has told me that lying about your education credentials is considered illegal in North Dakota and Oregon, so that he will not do that. He also told me that he emailed an attorney who replied to him with this email:



"Fraudulent information on a resume can be grounds for an employer rescinding a job offer, or terminating an employee after employment has commenced. I am not aware of any type of potential criminal liability, though if the information was provided in a sworn affidavit or otherwise under oath there is the possibility of a criminal charge of perjury."



Does anyone know what the sworn affidavit would be? Would that be the job application itself or another document?



Also, I have one more twist to this equation. He is considering purchasing a service called careerexcuse which creates a fake website, answering service, reference service and letters of recommendation. The answering service basically provides glowing reviews and confirms anything he tells them to say about his previous work experience. I guess what they do is make up a fake company and then he provides dates worked and responsibilities and the job title he held.



What are your thoughts on this matter? If I can convince him its criminal he would back down immediately. Sadly our son has the mentality that he is above morality and will do anything that will benefit him as long as he can't go to jail for it. He's definitely immoral and not ethical, to our disappointment, but not a criminal at least.
