Determination of Fault: Hit by Car in the Midst of Parallel Parking Attempt

My question involves a traffic accident in the State of: Oregon

I was behind a car, he used his blinker, and i stopped while he backed most of the way into a spot. When there was enough room to pass without going into the oncoming lane, I started passing, but as I did so, he began adjusting his parking maneuver, which involved pulling back out into the lane, hitting my car and leaving a dent and a scratch on the passenger side of my car with his bumper. We exchanged insurance info, but haven't decided whether to involve them yet. Who would be 'at fault'? Was I supposed to wait for him to fully complete his parking, parallel and close enough to the sidewalk, before I passed? Or was he supposed to look before pulling back out into traffic far enough to hit another car?
