My question involves criminal law for the state of: MI
Plaintiff - taunted/harassed defendant,
Defendant did not report harassment.
Harassment/physical contact seen by other coworkers and supervisors who advised defendant to "just ignore" coworker.
Defendant snaps and fight back
Defendant - Got into a fight with Plaintiff and another party.
Video recorded of fight. Defendant struck first. Plaintiff and 2nd party attacked defendant, defendant defended himself.
Plaintiff went to hospital because of injuries sustained.
Plaintiff - Filed charges against defendant.
Defendant jailed. Only plaintiff mentioned on report (no mention of 2nd party).
Defendant - charged with F2, court appointed lawyer suggested waive preliminary.
Defendant - Bonded out.
Can/Should file police report? Can/Should defendant file protective order against plaintiff, due to history of aggravation, taunting, physical contact of violence from plaintiff to the defendant in work setting? Can/Should defendant file assault/harassment charges against plaintiff and/or 2nd party for jumping in?
