Lost Property: Requesting Store Surveillance

My question involves personal property located in the State of: California



Hello, thank you in advance for reading my post.



Yesterday, I stopped at my local grocery store to pick up some medicine for the flu I just caught. While checking out at self-checkout, I set my iPhone on the register to feed my bills into the register. I had forgotten my shopping bags, called a clerk over to buy a paper bag, and mistakenly left my phone on the register in a hurry to get home.



When I noticed it was missing, I was able to track my phone 2 hours later by using Apple's Find My iPhone app, and set the phone to lost mode. I could see that my phone was still at the grocery store and whoever had my phone was periodically turning my phone off and on.



I returned to the store, and the first employee that I saw was a young man who was greeting customers at the door. I told him I had lost my phone and asked if anyone had found it. He responded happily that an employee had found my phone, and that he'd take me to her. He walked me over to the checker who had gotten me the paper bag, and said that I was the owner of the phone she found earlier. The girl responded with a blank look, and finally said she didn't know what he was talking about, and that there was no phone. Confused, he repeated himself, saying, "the phone you found earlier, it's hers?". She again denied having the phone and told me to check in with the front desk.



At this point, it was obvious this girl was lying to me by the reaction of the male employee, and by her guilty behavior (she couldn't look into my eyes when I spoke to her, she mumbled and seemed visibly flustered, etc). I asked at the front desk if my phone had turned up, and the manager quickly opened a drawer, responded with a curt "no", and then scampered off to return to his more important duties without another word.



The guilty employee returned, asking if my phone had a case on it (it did), then repeated "yeah, we didn't find it." She then asked for my contact details in case the phone did turn up.



I was able to track my phone for a few more hours (it remained at the grocery store) and it was obvious that it was in the possession of someone because it was being turned off and on. I think it's safe to assume that a customer didn't remain in the store for 6 hours with my phone. I finally sent my husband over to try his luck with finding it. I asked him to use the Find My iPhone app to turn on an alert sound while in the girl's presence. He went into the store, turned on the alert, and the phone was immediately turned off. (Stupidly, he didn't do it in her presence)



I called the store, asked to speak to a manager, and told him my situation. He put me on hold, and returned after a few minutes. He told me he spoke to the girl, and that she had no idea what phone I was talking about. She said she had no idea why the male employee said that. He also added that she was "very honest" and would never do that. He said I probably left the phone in the produce somewhere if it's still showing up on the tracker(I only grabbed a bottle of Tylenol, cough drops, a chicken broth and a box of Kleenex) and that I should retrace my steps because he couldn't help further. I also reminded him of the male employee who had said my phone was found, and after a short hold, his response was that he spoke to the male employee who now said that I misunderstood him, that he didn't say anything about a phone being found.



I called my local police department, and they told me because my phone was technically lost and not stolen, there was nothing they could do to intervene. The officer I spoke to was pretty shocked at the blasé attitude of the store's management, saying that he should've searched the employee's locker and had her empty her pockets on the spot. He said I could try to keep tracking the phone and could try to confront someone about it on my own, but the police had no power to do anything in this sort of case.



The phone hasn't been turned on again since my husband turned on the alert sounds, and I am no longer able to track the location of the phone.



Finally my question: Is there any way to get the management to review surveillance footage to confirm if their employee had ever found my phone? Do I have any other options in getting my phone back? There are definitely cameras in the self-check areas to make sure customers are being honest. I would put money on the fact that this employee did indeed find my phone and conveniently forgot that it was in her possession.
