Online Services: Online Auction Provider Not Fulfilling Duties; Result: I'm Losing Sales

My question involves a consumer law issue in the State of: Texas and California



The service provider has defects within their software. I have communicated this many times and escalated to the company president (who then retaliated by removing my discounts). This defect has been confirmed by half a dozen employees. As a result I have so far lost one (soon to be two) sale and refunded the customer. The defect and steps to reproduce the loss of food from my family's plate has been communicated many times over the past 3 months. In addition, the service for which I pay over $500 per month is not discounted for the functionality promised which hasn't been delivered. Who pay's full price for a bad haircut? The question is, what if any recourse do i have for myself, my family and any and all persons who have been and will be effected by the service provider not providing what they promised yet do not give consideration to those effected?
