Parking Tickets: Parked in a Spot with a Faded Handicap Marking on the Pavement, No Vertical Sign

mercredi 5 novembre 2014

My question involves a traffic citation from the state of: Illinois.

Good morning all. I woke up this morning to a lovely $250 parking ticket. I parked in a spot that had a faded sign on the pavement. There were NO vertical signs in front of me. On the other hand, there was a spot that was perpendicular to me about ~10ft away with a vertical sign and a CLEAR painted marking on the pavement. People ALWAYS park at the spot I'm in due to not having any handicapped people living in my apartment complex.

Here's an excerpt from municode.com with the signage requirements for my city: "Signage: Accessible parking spaces shall be designated as reserved for environmentally limited persons by providing an R7-8 (U.S. Department of Transportation standard) sign which contains the international symbol of accessibility (see figure 4 of this section). Such signs shall exhibit the words "$100 Fine" (or higher amount if required by this code). Signs shall be vertically mounted on a post or wall at front center of the parking spaces, no more than five feet (5') horizontally from the front of the parking spaces and set a minimum of four feet (4') from finished grade to the bottom of the sign. Such signs shall be located so that they cannot be obscured by a vehicle parked in the space."

I will fight this ticket if possible. But if not, looks like i'll just have to pony up the $250. Any help would be greatly appreciated. Thanks!
