My question involves a condominium located in the State of: Colorado
I just received a certified letter from my HOA notifying me that there will be a building wide treatment for bed bugs. If I do not provide access to my unit, they are planning to have a locksmith on site to open my unit at my expense.
They referenced this statement in the Declarations:
Subject to the rights of Owners as set forth in this Declaration, the Association shall:
Have all of the responsibility, powers, authority and duties permitted pursuant to the Act necessary and proper for the management, control, maintenance, repair, replacement and improvement of the Common Elements.
I believe I may have had an allergic reaction to pesticide use for bed bugs several years ago in a different home, and I do not want my unit sprayed. I'm willing to pay for my own heat treatment or some other non-chemical method of pest control. I was under the impression that pest control is my responsibility within my unit. Do I have any rights in this situation considering my past experience?
