Speeding Tickets: Speeding Ticket Issued Using Radar in Moderate Traffic, VC 22349(A)

My question involves a traffic ticket from the state of: California



I recently was cited for doing 80mph in a 65mph on I-580 westbound near N Flynn Road by a CHP Officer. It was a Sunday morning at 9:10 am and weather was clear and dry. Traffic was moderate as there was a Chargers vs Raiders game at the Colosseum and I suspect many people, just as myself and the caravan of vehicles I was in, were heading to the game to tailgate. I was accompanied by three friends in my vehicle and I was following a vehicle of five additional friends directly ahead of me. We were all travelling at 65mph in the far left lane, the "fast" lane. I was two car lengths behind my friends vehicle and had several cars directly behind me. This is a three lane west bound section of highway and there were cars passing us on the right in the middle lane. I recall seeing the CHP cruiser in between two passing Semi Tractor Trailers in the slow lane just as we rounded a slight curve. As I passed, I saw the officer put down his radar and accelerate onto the freeway after the trucks had passed. He then weaved through traffic and wound up squeezing into the lane directly behind me and the cars behind me and turned on his lights. I then pulled over and the officer asked me if I knew why I had been pulled over and I honestly replied no. He stated that he clocked me at going 80mph. I asked him how he could have possibly identified it as me travelling that speed as there were so many vehicles in between his location and mine when I saw him with the Radar, not to mention the brief moment he had to shoot get a reading between the passing semi trucks and he stated "You were the one I saw." He wrote me up for doing 80 in a 65. I was in a red colored rental vehicle if it matters.



I had witnesses in my vehicle as to the fact that vehicles were passing us on the right in the middle lane as well as my friend, the driver in the vehicle directly ahead of me who can attest that he was doing 65 and I was following two car lengths behind him the entire time. I haven't had a speeding ticket in nearly ten years and I honestly was not travelling at 80mph. I plan to contest the ticket via TBWD and would appreciate any input on how to best present my case. I have also researched the area and found that the location where I was issued the ticket is considered the beginning portion of congestion during normal traffic days.
