My question involves a traffic citation from the state of: Florida
So I found a tow truck in the midst if towing my car, fine, I misunderstood the sign. But when i politely asked if there was anything I could do, he demanded $100 cash, which i believe violates this:
"3. A person in the process of towing or removing a vehicle or vessel from the premises or parking lot in which the vehicle or vessel is not lawfully parked must stop when a person seeks the return of the vehicle or vessel. The vehicle or vessel must be returned upon the payment of a reasonable service fee of not more than one-half of the posted rate for the towing or removal service as provided in subparagraph 6. The vehicle or vessel may be towed or removed if, after a reasonable opportunity, the owner or legally authorized person in control of the vehicle or vessel is unable to pay the service fee. If the vehicle or vessel is redeemed, a detailed signed receipt must be given to the person redeeming the vehicle or vessel."
He didn't stop, and $100 is not one half of the rate, it's the full rate. He then proceeded to not talk and just in got in his truck.
It gets better.
I was between the truck and my car, not knowing our conversation had ended as he threatened to call the police for not moving out of his way. Though, im not a tow truck driver and dont know about the safety of where to be. He just started driving away, with me in the middle of the two vehicles, i was never given the chance to move, one side was farther between the vehicles and the other was into the middle of the street, so luckily i was able to get far enough outside the vehicles and was clipped by my own car. I rolled so i wasn't injured. I called the police and filed a report, battery I believe. But he wasnt arrested. I have a witness that heard the thump and saw him speed away at an unsafe rate. What now?
