Traffic Accidents: What Can I Go After This Person for

My question involves an injury that occurred in the state of: Rhode Island



Hello, a couple of days ago I was hit by a NH vehicle that had no insurance. It's basically 100% their fault. It looks like my uninsured property damage will cover repairing the car. However, there are several things that I am going to lose out on this. The first being this car was completely original, OEM parts with a clean history. While I get to pick the shop, the insurance company will obviously demand the cheapest part options from the shop which means I will not be getting OEM parts in many cases. Also the fact that the vehicle will no longer have a clean history, that seriously devalues my car.



Now my vehicle is not some crazy classic vehicle, but it is a vehicle that has a large following, retains it's value well and sells for blue book value or more almost every sale.



I want to know if I have any grounds to sue this lady for the loss of value to my car and if I can elect to pay the difference for OEM parts and then turn around and sue her for that as well?
