Traffic Lights, Signs and Controls: Red Light Camera

mercredi 19 novembre 2014

My question involves a traffic ticket from the state of: Washington

RCW 46.63.170 (h) All locations where an automated traffic safety camera is used must be clearly marked at least thirty days prior to activation of the camera by placing signs in locations that clearly indicate to a driver that he or she is entering a zone where traffic laws are enforced by an automated traffic safety camera.

I can't find anywhere a definition of what "clearly marked" means. In Seattle, the warning signs of an upcoming traffic safety camera precede the intersection by various distances. There is no uniformity. I cannot find any rule in Seattle Municipal Code nor RCW that regulates the positioning of these warning signs, so it seems to hand a lot of discretion over to the City.

Since a commercial vehicle that I was allegedly driving (so says my employer) was caught on camera running a red light, I am wondering if I can make a convincing argument that the sign warning of the upcoming traffic camera was not posted sufficiently in advance of the intersection. Any thoughts?

I did find this on a SDOT page describing School Zone Signage: "An advanced warning sign located 300 feet before the start of the school speed zone. A speed zone sign 300 feet in advance of the school property boundary or school marked crosswalk." By my reasoning, the warning signs for the traffic safety cameras should also precede the intersection by at least 300 feet since a car traffic intersection poses a similar risk of injury.
