Post-Conviction Relief: Can I Reopen a Closed Case

samedi 11 avril 2015

My question involves criminal law for the state of: Michigan.

I was FORCED to plead guilty to and attempted stalking charged. This is the only charge of any kind on my record. I had to use a public defender attorney, which is part of the problem. I feel Like I got the shaft and was never given an opportunity to explain my intent. I have no intent to stalk anyone at all. But I was trying to catch a women I had my eye on and ask her out on a date. From what I was told you can't reopen a case unless you have new information that was not brought up originally. I never had a trial just a plea "deal". The major information is that was NOT brought before the judge was that the officer that put together the police report was begging me to ask this women out on a date. He was almost offering me to make reservations at the restaurant. To me this kills the prosecutions case and was never brought up. All I wanted to do is what the police officer told me to do. But the attorney really didn't want to go to bat for me. This took place last summer 2014. My INTENT was to do what the Police officer told me to do.

Do I have a case to have it re-opened? I really feel like I got screwed and my side of the story was never told. Yes I know it would involve hiring an attorney. But I want a clean record.

Thanks,
