My question involves labor and employment law for the state of: California.
I work at Pizza Hut currently as a cook. I have applied for a management position 3 times now. The first two times failed, and I'm currently waiting for the results of my third application.
My application failed at the background check. For some strange reason, you need a clean driver's record to be a manager at Pizza Hut. Keep in mind that I walk to work and do not deliver. I asked the other managers at my work and they said they never have to "drive on the job".
Anyways, here's what's giving me trouble. in June 2012, I had a car with expired tags. I got a fix-it ticket for it. At the the time I was unemployed and was unable to pay my registration, therefore I was unable to pay the ticket. I got a failure to appear, and my license was suspended. About two months later, I sold the car. Seeing as I had no car and no job, I had to let the suspension continue. A few months later, I got some inheritance and bought a cheap small motorcycle. I went to the DMV to take the tests and passed. Registration and insurance was good to go. I asked the DMV clerk if I was clear to drive legally, she said yes. At that point I thought the suspension was gone due to her answer, the ease of obtaining my motorcycle license, and the fact that I notified the DMV that the old car was no longer mine when I sold it. I was young and naive.
In August 2013, I started working for Pizza Hut. 6 months later, my boss asked me to be a manager, and I happily accepted. I filled out the applications. The result that was sent back said my license was suspended. I go through the courts, learn that I now owe them $1000 before they would give my driving privileges back. I found out another way, got a lawyer to reinstate my license before I paid the court fine. He got the $1000 fee down to $200. At this point I had until April 2015 to pay the $200. I went to the DMV, paid around $150 to un-suspend my license. At this point I had a VALID driver's license, and a court fine that was "in good standing".
I tried applying again, 3 months later. I had the same problem, but this time I couldn't get hired for a PAST suspension (even though I walk to work :/).
At this point I was just saving up to pay the court fee. I finally got it paid this March (2015). I checked my DMV record and it's clean. I checked the court records and it says fees payed, case closed.
I haven't received the results of my current management application, but I need advice on what to do if the PAST suspension still shows up on my background check. Is there any action I can take to remedy this situation? I need the promotion badly and I'm worried that if I don't get it, this issue will come up with future employment.
