My question involves a consumer law issue in the State of: Texas
Ok, first off I apologize for the likely length of this post.
On March 16th my wife and I were driving around looking for potential vehicles. We weren't thinking of seriously buying one at the time, but when we rolled through the Honda dealership, we saw a car we'd been wanting for years -- A Honda Element. They stopped making them in 2011, but they are great cars, especially with a family consisting of 3 big dogs. We stopped, walked up to it, and in about 20 minutes was seated in the salesman's office answering his questions to get the ball rolling. It had 56k miles on it, priced around 12k, about 1k less than KBB. (I know, should have talked him down, but I was in a buyers high. I mean, we NEVER see these cars for sale.)
Before we got too far, we asked for the carfax. It's not a carfax anymore, something called an Autocheck I believe, and they supplied one. My wife was looking through it and noticed there was a recall listed for the air bag. She asked our salesman if the recall had been fixed. He assured us all the recalls had been taken care of and we were good to go.
We got to the finance office and he told us we were eligible for a 3 year 36k mile warranty, based on the age and mileage. We almost passed, it was an extra 2k, but decided the peace of mind was worth it. (Good thing.) So, our salesman asked us to bring the car back in within the next few days in order to get it certified, since we'd bought the warranty.
This was Monday. My wife took the car in on that Friday, first thing in the morning. Lo and behold, the air bag recall was never fixed, so he couldn't let her go without it being fixed.
It's now been 3 weeks since the car went in, and at last check, they had no clue where the part was, when it would be in, or where it was even coming from. ( I asked, assuming it was coming from somewhere within the states.) Now, our salesman wants us to come in and sit down so they can take care of us. They've been trying to shove a rental car down our throats, not realizing that we don't want a rental car--we just want the car we just bought.
The thing that really, really pisses me off is the fact that if we had not purchased that warranty, we would have driven off assuming the recall had been fixed. I believe the recall was because the air bag could explode with enough force to send shrapnel flying into the cab. Decapitation?
So, my questions, as jumbled as they likely sound, are these:
If I wanted to just get out of the car, which I don't, is there any legal recourse?
What would they do for us to 'make us happy?' I mean, I told my wife to just make them put a nice touch screen nav system in, or a cargo rack, or something. I don't know. Every time I think I about it I just get pissed off. I mean, we've already started paying on the car. (We want to pay it off early.)
And I know I sound like a whiny bitch or something, but we had this car THREE days, and they've now had it 3 weeks. And they KNEW there was a recall still on it. They had to when they put it in their system, right? I know they don't have to disclose that, but to be lied to really eats me.
