Traffic Accidents: I Hit a Parked Car. What Are My Rights when Paying for Damages

dimanche 12 avril 2015

My question involves an injury that occurred in the state of: California

We hit our neighbor's parked car and left three dents in their side fender. We found a guy with great reviews who is an expert in dent repair. Can fix their fender for about 400 dollars. Our neighbor refuses to go with anyone we recommend. They took it to their friend's auto body shop which of course wants to completely replace the fender, and charge us 2500 dollars. Our insurance deductible is 1000. If we can fix it without having to go through our insurance, we would rather do that and not risk our monthly going up and paying the 1000 dollars.

When we met up after the initial accident, we did not give them our insurance information because we wanted to take care of it without. They are now asking for it and insisting we go with their people, refusing to even try our dent guy.

What are our rights? Are we obligated to go with whoever they want and fix it however they want, even if it is unnecessary? If we didn't give them our insurance, can they find it somehow and go through our insurance anyway?
