My question involves court procedures for the state of: Federal Court
After I served a complaint on a defendant they took 60 days to file their first rule 12(b)(2), 12(b)(5), and 12(b)(3) motion with the court. Isn't the time limit for them to file a rule 12 motion 21 days after receiving the summons? I did asked the judge for a default judgement but it was denied because I didn't have all my paperwork in order. Can I have their motion striked for not being timely?
