My question involves adoption law for the State of: Iowa
I'm going to try and make this as short and detailed as possible. My husband wants to adopt my son. His biological father hasn't seen him by choice since 2009 on his 5th birthday. Yes, he pays child support. My husband has been raising my son for almost 4 years now as his own. Before we got married we tried doing a name change for him just to kind of get the ball rolling, adoption has always been something we all three wanted eventually. Long story short, when doing the name change my ex contested it. The judge ruled in my exes favor pretty much just because we weren't married yet, only engaged. He said it would be easier to do an adoption once we were married. This was almost 3 years ago. Well we are finally at the point where we can afford to hire a lawyer and start the process. After the name change my ex briefly talked to me again and my son once, now he has disappeared again. I have emails between the two of us where he clearly says he has no reason to come to Iowa and that if I want him to see our son that I will have to take him to him (he lives in Washington last I knew). My son doesn't have any contact with ANYONE in that family, and that is also by their choice. He was still seeing his grandma, grandpa, and uncle for a little bit, but I got tired of blowing thier phones up all the time for them to see him. My husbands entire family has always treated my son as part of their family and support this decision. Like I said before, he pays child support every month and has done so since 2011, but that is it. He has me blocked on Facebook, every time i find his number out he changes it, and he's stopped responding to my emails again. I'm not sure if he will contest this too, but if he does I'm scared of losing. I don't want to waste all of this money, but I also don't want to keep putting it off.
I guess I just want some input or advice. Anything anyone can tell me about how to approach his would be very appreciated.
