My question involves labor and employment law for the state of: Virginia
Long story short, a police officer pulled me over for speeding and he didn't think I stopped quickly enough, so he arrested me. Because it was my first traffic stop, I felt very scared as to why a huge man was putting his hands on me and pushing me (he broke my shoulder and back), and I panicked and did not believe he was a police officer because I thought a police officer couldn't act in such a way. I know better now, but I wound up with a single misdemeanor assault conviction, I'm in a teaching preparation program, and I've been declined in two school districts due to not meeting background check criteria. The assault misdemeanor conviction is now two years old. I need to pass the check in order to earn my license, and I'm just wondering if anyone has had success in passing a school district background check with an assault misdemeanor conviction? Is it possible somewhere? I have asked other school districts' HR departments and they say it is not disqualifying, and to go ahead and apply, but I am scared as I do not know what to believe given these past experiences. I get very depressed for a long time when I get denied, and I wonder if it makes sense to keep trying? Legally, I know I am OK to teach, as I was not convicted of a barrier crime, but I know many schools might turn me away due to the conviction.
