Cosigners: Primary Cosigner Wants to Take Car

samedi 7 mars 2015

My question involves an auto loan or repossession in the State of: Virginia

For reference, I am 26 years old. I live in North Carolina, but car is registered in Virginia.

In 2010, my dad cosigned a car with me. He is primary and I am secondary. He lives in Virginia, I live in North Carolina. It shows this on the loan. Since then, I have made every car payment (totaling around $12,000), the insurance is in my name (totaling around $6k), I have made all the repairs (over $4k), the registration is in my name, but registered at his house. I have fallen on hard times. I was laid off from my old job back in October 2014 because they were halving the amount of employees in the plant, so I went on unemployment. My unemployment has recently ran up and I'm still frantic on a job search. This past month (February) I was unable to make the car payment. My dad is threatening to come down to NC and take the car if he is forced to make February's payment. This takes away my ability to get a job and get back on my feet. Being the primary signer, is he allowed to do this, or do I have rights as being secondary signer?
