My question involves an easement in the state of: FL
It is a deeded easement (I own the land of the driveway and pay the property taxes) that allows other neighboring parcels to use for ingress/egress to their lots, even though they are not land-locked.
Now our newly started HOA wants to call our driveway a "common area". Per the Plat the maintenance on the driveway is to be shared by the parties using it.
We have been trying to collect a portion of the two yeas worth of grass cutting from neighboring lot owners with no success. HOA wants to charge assessments to take care of the "maintenance". That means I will have no say so how my driveway is maintained or who maintains it if they are successful.
Can they just do that? It's like they are saying "Hey, you own it and pay for it but you can't do anything with it!" Who makes the determination whether it's an easement or a common area? I need to know who to go talk to as ap.
