My question involves a child custody case from the State of: Maine ... Divorce and parenting plan were final Mid Sept 2014..dad has primary residential custody. shared legal Custody. Mom has visitation. dad lets mom have 7 year old daughter more then parenting plan says. Mom wanted no week ends. But she usually does have her 4 to 6 hours on one week end day as dad is fine with mom having her even though its not in the parenting plan. is this ok?..My real question is mom states she hopes to have her own apartment by June and then will resume full time care of daughter and daughter will live with her..Just because mom has her own apartment is this grounds for a change of circumstances? Parenting plan states when mom has her own apartment daughter may spend 4 nights and days with mom one week then other week 2 days and nights..Thats about 50/50 anyways...Would judge even revisit parenting plan in less then a year? And Does having a apartment but no job be a change in circumstances new boy friend I guess will be paying for apartment..Neither parent pays any child support as none was asked for by either parent. Things are going fine .Not once has dad not had child ready and waiting for mom to pick up daughter. but often mom is late or changes plans can't get her ect. Not sure if mom plans on living in daughters school district or not..parenting plan states daughter will continue attending current school and both parents agree to this.
