Determination of Fault: Daughter Ticketed for Careless Driving in Snow Storm - Cause of Accident Unsafe Speed

My question involves a traffic accident in the State of: NJ



My daughter was travel on the Atlantic city expressway, day time, about 4 inches of snow and snowing at the time



She began to slide sideways, and was hit(v2) from behind in the passenger door, and 3rd car(v3) hit v2.



She never hit anything herself, only slid, to a near stop. Police officer ask if she hit anything - she stated No, asked if anything hit her, she stated Yes, v2.



Police officer never asked her what speed she was traveling, or if she was on the phone.



At the scene she was cited with:



Careless Driving 39:4 97



in addition on the court document we received for the court date In the mail it has:



Use of Cell phone 39: 4 97.3





accident report states - investigation revealed D1 was traveling a unsafe speed for road conditions, v1 lost traction and spun out, coming to rest in roadway



d2, attempted to slow but was unable to safely navigate around v1 and struck v1



d3 also observed v1 spun out and attempted to slow down but was unable to stop before striking v2



Speed limit was 35(due to snow), daughter says she was well below that, around 25, and was not on the phone or txting.



Neither driving 2 or 3 were cited for any violations



in addition, at least 2 mistakes on the accident report -



1) my wife's name and drivers license number is listed as the driver(car is in her name so I guess that is where he got that)

2) Driver 2 is listed at female, It was a male.





how should we go about fighting this ?



Any advice would be greatly appreciated.
