My question involves a traffic ticket from the state of: WV. 3months ago a cop had someone pulled over on the 4lane, I saw him as I was approaching, another car had just passed me in the fast lane, I swayed over towards the fast lane to move away from the cop & other vehicle , but not half a minute later I got pulled over, cop asked if I knew why ,I replied no, he said not yielding, I said I swayed away , he replied , that wasn't good enough , his exact words! But by the time I swayed from him I was already around him,so I straightened back up into my lane, also as he had me pulled over, several cars passed us and never thought about changing lanes to yield to us, and it was clear for them to do so. I went to the magistrates office that same day to get it dismissed , he sent me to the prosecuting attorney , who told me that he wasn't doing no more of the magistrates load , so now 3 months later , I get a summons to appear in court, I am fighting this, I did yield , just not to this cops satisfaction, that shouldn't warrant a reason to give me a ticket . I'm 40 yrs old with only 1 speeding ticket my whole life,and that was back when I was 20yrs.old. Never been in any kind of trouble, or in court before , anyone have any advice? Just because they wear a badge doesn't mean their opinion is right and mine wrong! The cop had an attitude and apparently was ticket happy this day since right before me , he had another pulled over, but regardless , I never even realized that you could even get a ticket for this . He wasn't behind me he was pulled off the road , writing someone else a ticket , and I did sway to my left to get away from him, but by that time I had already passed him, so I straightened back up into my lane on the right .any good advice because I am fighting this.
