My question involves real estate located in the State of: NYC
When I purchased my home in 2001, there was a 5 foot wooden fence between my neighbor and I.
Circumstances dictated that a taller fence was required, so I installed a 6 foot high, chain link fence with privacy slats up against the wooden fence on MY side. Also, the finished side of the chain link fence was made to face my neighbor.
Last year, my neighbor cut down the wooden fence, leaving the fence I installed.
Were they allowed to cut down the wooden fence without my permission?
It was explained to me this way:
Each of us owned one side of the wooden fence. When I installed the chain link fence, I relinquished ownership of the wooden fence; it became his to do with it as they pleased. But once they took down the wooden fence, they now began using one side of the chain link fence. As a result, they now are required to reimburse me 1/2 of the cost of the chain link fence and also must move it to the property line or replace the fence they took down.
Is this true?
