My question involves a child custody case from the State of: Tennessee
My wife are currently going through a divorce, and this question is regarding her nephew that we have legal custody of...
In 2011, my wife's sister signed over her son to us, so we could have legal custody (he was 2 at the time, now 6) because she couldnt take care of him and was very unstable. The father was in prison at the time, and up to this point, nephew hasnt seen his dad. Since that time, sister in law hasnt had much contact at all with nephew, so for the last 3.5 years, weve pretty much been it for him. Fast forward to the present, and my wife and I are currently going through a divorce, and do have 1 child that is now 3 years old, in addition to our nephew. my question is with nephew...his dad has been out of prison for 2 years now. We dont receive any child support from them, because neither of them work and are just unstable. Am I in any way, obligated to include him on our parenting plan and to pay child support to my wife for the nephew, even though he has 2 parents that dont work, but are able to, just lazy and would rather sit around and drink. And with the custody order for nephew, since me and my wife are both listed, will this be null and void once our divorce is final, reverting to my wife only? I wasnt sure because since he is her relative, and my name is only on there because we were married? Or do I need to petition to have my name removed from that custody order?
