Non-Performance and Breach: Not Complete - Ask for Refund

My question involves a consumer law issue in the State of: Minnesota



I hired a licensed contractor to perform radon mitigation in my home in the Fall of 2013. With Radon they certify their work to be below a certain level and after the contractor did the initial work the levels were still too high. The last year and a half it has been a source of frustration as it usually took me three months to get him to respond to me. The radon level is still well above our agreed upon level and he has now left the radon business and his certification expired almost a year ago. What are my options here? I would like to ask for a refund but am unsure what is reasonable. He wants me to hire someone else to finish job and we will come to an agreement. based on his lack of communication over the last year I would like to just be done with him but do not want to lose all of my money.
