My question involves an injury that occurred in the state of: California
It's a one lane on each direction road with two-way stop sign. I was waiting at the stop sign trying to make a left turn. I felt the head of my car was a little far out so I put the gear to reverse and tried to back out a little bit. My car has rear camera and also alarm sensor so I can see very clear. But I think the car behind thought I was moving forward and so did he and so his front bumper hit my rear bumper.
The story supposed to end there. But stupid me agree with his offer. This is how it goes. We all stepped out and he suggested we should just pull over first. So we went back to our cars, made the left turn and pull over on the side. My car has very minor scratches on bumper. I cannot tell if any damage on his car was caused by me because his car was not in a well maintain condition so it's hard to tell which scratches were new. So this guy said maybe we can settle without insurance involved and I agreed. He mentioned he would get an estimate first and I agreed too. So we left the scene. After I got home (about 5 minutes drive) I realize I forgot to ask for his insurance. Because my son was in the car and was cranky so I was distracted and forgot that. So I called him and asked his insurance and he said okay. 20 minutes later I texted him again to remind him but he never sent to me.
Next day (Saturday) he sent me an estimate for over $900 that includes replacing a new bumper and new paint. So I called him and asked if he is okay to go to a body shop I usually go but people there do not speak English so I will go with him and he said alright. So I setup appointment with him for Monday. On Sunday, he called me and said by law he has right to go to any body shop he wants and he doesn't feel comfortable to go a place where doesn't speak English. He asked me if I want to pay him in check or we can go through insurance. I said I want to go through insurance and ask for his insurance again. The guy said he didn't have it with him and he would send to me that night. 2 minutes after we hang up he called me again saying he just contacted his insurance and his insurance told him to tell me that I only need to provide his cell phone number to my insurance and they will take care from there. I told him I know how to report to insurance company. If he doesn't want to give me his insurance or he doesn't have insurance then I will just tell my insurance exactly. And he said he has it just not with him and he will send me that night and we hang up @6:35PM. Right after we hang up and at exactly the same time (@6:35PM) he sent me insurance card which he claimed he didn't have it with him. At that time I feel this person is trying to squeeze cash from me rather than have his car fixed.
I'd like to know if this accident is 100% my fault. I didn't say it's my fault at any time of our conversation. But since my car is okay so at first I did think if I can get everything resolved within $200 then I'd pay since I was confidant that for the scratches I cannot even tell in his car the repairs should be within $200 too. Since the guy demands more than I want to pay, I am going to report to my insurance.
