Modification of Custody: Can I File a Motion for a Drug Test to Modify Current Court Order

My question involves a child custody case from the State of: Alabama, My husband was just awarded permanent child custody of his three year old daughter. The courts are well aware of the mothers previous drug history and even at the court hearing when asked if she would do drugs again she said there may be a possibility. Well since she lost custody we have reason to believe she is back on drugs she is now living with a guy that has been arrested 90 times and just got out of prison for beating up his last girl friend. Since I can not get DHR to do a drug test on her bc it is court ordered that she have visitation they (DHR) will not get involved and law enforcement says they need more proof to do anything. I was wondering is there anything I can file to protect this baby from going over there and getting hurt worse than she has already been?
